Terms of Use

Effective date: October 7, 2026​

These terms are an agreement between you and OVE, Inc. (“OVE”, “we”), a Delaware corporation, for the OVE App, the OVE® Sensor and the OVE Sensor app (together, “OVE”). By creating an account or signing in, you agree to them. Section 13 requires individual arbitration of most disputes and waives class actions. You can opt out within 30 days.

1. Who can use OVE

You must be at least 18, live in the United States and give true, current information. One account per person.

2. Your account

Keep your password and verification codes private. OVE will never ask you for them. You’re responsible for activity on your account until you tell OVE Support it was compromised.

3. Using OVE

OVE lets you verify your identity and pay at participating merchants with your fingerprint. Payments are processed by our payment partners. The merchant, not OVE, is responsible for the goods and services you buy. Questions about a purchase go to the merchant first; you keep any rights your card issuer or bank gives you.

4. Fees

The OVE App is free for users. Your bank, card issuer or mobile carrier may charge its own fees.

5. Messages

You agree that OVE may send verification codes and account notices to your phone and email. These are part of the service. Reply STOP to stop non-essential texts.

6. The OVE Sensor

The sensor and its software belong to OVE or the merchant that owns the unit. Don’t open, modify, copy or reverse engineer the sensor, the apps or their software, or try to get around their security.

7. Things you may not do

  • Use someone else’s fingerprints, identity or account

  • Use OVE for fraud or anything illegal

  • Interfere with OVE’s systems or other users

  • Resell or give access to your account

 

8. Blocks, deactivation and termination

  • Failed attempts: after repeated unsuccessful verification attempts, your account is temporarily blocked. If the attempts continue, it is blocked until you contact OVE Support.

  • Deactivation: you can deactivate your account in Profile → Deactivate or delete account and reactivate it within six months. After six months it is permanently deactivated, your fingerprints are fully deleted and it can’t be reactivated. You can also choose Delete account on the same screen: your account is permanently deactivated right away, with the same result, and can’t be reactivated.

  • By OVE: we may block or end your account if you break these terms, to prevent fraud, or if the law requires it. We’ll tell you unless the law or a security reason prevents it.

 

Sections 6, 9 to 14 continue after your account ends.

 

9. OVE’s rights

OVE, its technology and its patents belong to OVE. We give you a personal, non-transferable right to use the apps while these terms apply.

 

10. Privacy and fingerprints

Our Privacy Notice and Biometric Policy explain how we handle your information. We collect fingerprints only with your separate Biometric Consent.

 

11. No warranties

OVE is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We don’t promise OVE will always be available or error-free.

 

12. Limits on liability

To the extent the law allows, OVE is not liable for indirect, incidental, special or punitive damages, and OVE’s total liability to you is limited to $100. Nothing here limits liability that the law doesn’t allow us to limit, including our obligations under biometric privacy laws.

 

13. Disputes and arbitration

  • Talk to us first: email support@ovetouchngo.com and give us 30 days to resolve it.

  • Arbitration: if we can’t, the dispute is resolved by binding individual arbitration under the American Arbitration Association’s Consumer Arbitration Rules, in Los Angeles County or by video. OVE pays all arbitration fees beyond your filing fee.

  • Small claims: either of us can use small claims court instead.

  • No class actions: disputes are brought individually, not as a class or representative action. This doesn’t stop you from seeking public injunctive relief in court where California law allows it.

  • Opt-out: email support@ovetouchngo.com within 30 days of creating your account with “Arbitration opt-out” and your name and phone number. Opting out doesn’t affect anything else in these terms.

 

14. Law and courts

California law governs these terms. Any case not in arbitration goes to the state or federal courts in Los Angeles County, California.

 

15. Changes

We may update these terms. We’ll post the new version and email you before it takes effect. If you keep using OVE after that, the new terms apply.
